TERMS AND CONDITIONS – ALTO CURTAIN

1. Definitions
In these terms and conditions,
the following definitions apply:
Alto Curtain:
the trade name of June Living Group B.V., registered at Emmalaan 7, 1075AT
Amsterdam, the Netherlands, listed in the Dutch Chamber of Commerce under
number 99062992, hereinafter referred to as “Alto Curtain”, “we” or “us”.
Customer:
any natural person or legal entity placing an order with Alto Curtain.
Products:
all curtains, curtain fabrics, rail systems and curtain accessories offered by
Alto Curtain, which are produced fully made-to-measure.
Services:
advice by e-mail or telephone, optional measuring service and optional
installation service, carried out through our external partner Decopool.
Made-to-measure:
products manufactured according to the customer’s specifications, including –
but not limited to – dimensions, height, width, pleat, make-up, fabric choice
and colour.
Agreement:
any agreement concluded via the webshop, by e-mail or via a separate invoice.
2. Applicability
2.1 These terms and conditions apply to all offers, agreements, orders, deliveries and services of Alto Curtain.
2.2 By placing an order, the customer declares to have taken note of and to agree with these terms and conditions.
2.3 Deviations from these terms
are only valid if confirmed in writing by Alto Curtain.
3. Products and made-to-measure
3.1 All Alto Curtain products
are 100% made-to-measure and are produced based on the specifications provided
by the customer.
3.2 The customer is responsible
for providing correct dimensions, unless the measuring service is used. The
dimensions supplied by the customer or entered via the configurator are
repeated in the order confirmation. By accepting the order confirmation (either
explicitly or by proceeding with payment) the customer confirms that the
dimensions are correct.
3.3 Due to the nature of
textile, slight colour differences may occur between different production
batches. Such differences are considered normal and are not covered by
warranty.
3.4 For extra tall and/or extra
wide curtains, room-height fabrics may not be sufficient in height or width. In
such cases, multiple fabric panels are professionally joined together with
craftsmanship.
3.5 This processing is carried
out with the utmost care and experience. Depending on fabric structure,
lighting, viewing distance and environmental factors, a seam may be visible.
This is a technically and aesthetically unavoidable consequence of made-to-measure
work at extra dimensions and does not constitute a production defect.
3.6 Visible seams on extra tall
or wide curtains do not entitle the customer to repair, replacement,
dissolution of the agreement or compensation, and are not covered by warranty.
3.7 For extra tall curtains,
fabrics may be turned (not processed room-height). This may cause slight
stretch, tension or shape variation. This is a normal textile property and is
not considered a defect.
3.8 A maximum tolerance of 2%
deviation in height or width of the end product is considered an industry
standard and is not covered by warranty.
3.9 Optical effects such as
pleat formation, waving, light effects, reflection or the visual appearance of
curtains hanging crooked due to uneven walls, ceilings, floors or window frames
are not covered by warranty.
4. Ordering process
4.1 Orders are placed via the
website or, for made-to-measure outside the standard configurator, by e-mail or
invoice.
4.2 An order is final once
payment has been received in full.
4.3 Cancellation is possible
within 24 hours after placing the order. After this period, production starts
and cancellation is no longer possible.
4.4 All advice provided by Alto
Curtain, regardless of the form of communication (e-mail, telephone, video
call, chat or otherwise), is informative and indicative in nature. The customer
remains at all times solely responsible for the final choices regarding
dimensions, fabric choice, colour, rail type, motorisation, pleat and other
specifications.
4.5 The customer is responsible for checking all
order details – including dimensions, fabric choice, colour, rail type, pleat,
motorisation and other specifications – before completing and paying for the
order. The specifications entered in the webshop configurator and confirmed by
the customer are deemed final and correct after payment.
4.6 Once payment is received, the order is sent
into production immediately. Changes or corrections to specifications are no
longer possible after the moment of payment, except for the right of
cancellation within 24 hours as described in article 4.3.
5. Prices and payment
5.1 All prices are inclusive of
VAT and based on made-to-measure production.
5.2 Payment is made in full in
advance via the payment methods available through Shopify Payments.
5.3 The order will only be
placed into production once full payment has been received.
6. Delivery and lead times
6.1 The average production time
is 3–4 weeks. The shipping time is approximately 1 week. The total delivery
time is on average 4–5 weeks.
6.2 Stated delivery times are
indicative and not binding deadlines. Exceeding them does not entitle the
customer to dissolution of the agreement or compensation.
6.3 Delivery is carried out via
NE.nl or other carriers engaged by Alto Curtain.
6.4 If the customer is not
present at the agreed delivery time or refuses delivery, additional delivery or
storage costs may be charged.
6.5 If delivery takes place at a
pick-up point or alternative location because the customer was not at home, the
risk transfers to the customer from the moment of delivery at that location.
Damage occurring thereafter or discovered only later falls outside the
responsibility of Alto Curtain.
7. Transport & damage
7.1 The customer must inspect
products for damage or imperfections immediately upon receipt.
7.2 Any damage must be reported
by e-mail within 48 hours of receipt to info@altocurtain.com, accompanied by
clear photographs of the product, the packaging and labels.
7.3 In the event of visible
damage, the product may not be mounted, installed or cleaned. After
installation, any right to repair lapses.
7.4 Alto Curtain is not liable
for damage caused by:
- incorrect storage by the customer
- failure to collect a package on time
- damage caused by third parties
- damaged or opened packaging outside our control
8. Measuring service & installation service
8.1 Measuring and installation
services are carried out by our external partner Decopool.
8.2 When the measuring service
is used, a full measuring guarantee applies: measurement errors will be
remedied free of charge.
8.3 Decopool is independently
responsible and insured for damage occurring during measuring or installation.
8.4 Alto Curtain acts as an
intermediary and is not liable for damage or errors arising from the work of
the external partner.
8.5 If the customer installs the
products themselves, any claim under the installation guarantee lapses.
9. Warranty
9.1 Alto Curtain applies a
warranty period of 24 months on made-to-measure products, in accordance with
the manufacturer’s warranty conditions.
9.2 For motorisation, a warranty
period of 12 months applies.
9.3 The warranty exclusively
covers demonstrable production defects, including:
- stitching
- make-up
- seams
- mechanical components of rail systems
9.4 Excluded from warranty are,
among others:
- discolouration caused by sunlight, heat, smoke or condensation
- shrinkage of 1–3% after washing or cleaning
- damage due to incorrect maintenance or cleaning
- damage caused by pets
- damage caused by humid environments
- natural stretch, tension or pleat formation
- visible seams on extra tall or wide curtains
- optical deviations caused by structural conditions
9.5 After installation by the
customer, any claim regarding installation-related complaints lapses.
10. Returns
10.1 Made-to-measure products are excluded from the statutory right of withdrawal (art. 6:230p sub f of the
Dutch Civil Code).
10.2 Only standard products (such as pull rods) may be returned within 14 days of receipt.
10.3 Return costs and the risk of return shipment are borne by the customer.
10.4 Returned products must be returned unused, undamaged and in their original condition.
11. Complaints procedure
11.1 Complaints must be submitted in writing via info@altocurtain.com.
11.2 Alto Curtain will respond within 14 days of receipt of the complaint.
11.3 If a complaint cannot be resolved by mutual agreement, the dispute will be submitted to the competent court in Amsterdam.
12. Liability
12.1 Alto Curtain is exclusively liable for direct damage resulting from a demonstrable failure.
12.2 Alto Curtain is not liable for consequential damage, indirect damage, business loss, loss of profit, depreciation of interior or damage caused by third parties.
12.3 Alto Curtain’s liability is at all times limited to the amount of the relevant order.
12.4 If damage can be recovered from an external partner or carrier, Alto Curtain will facilitate this process.
12.5 The limitation of liability in this article expressly also applies to damage arising from advice given by Alto Curtain, including advice given during video calls, e-mail, telephone conversations or via the configurator on the website.
13. Intellectual property
13.1 All photographs, renders, texts, designs and visuals are the property of Alto Curtain.
13.2 Use, reproduction or publication without written permission is not allowed.
13.3 Customers may only use visuals for private inspiration.
14. Privacy and cookies
14.1 Personal data is processed in accordance with Alto Curtain’s privacy and cookie statement.
14.2 Alto Curtain uses, among others, Shopify, Klaviyo, Meta Pixel and Google Analytics.
15. Force majeure
In the event of force majeure (including but not limited to pandemics, transport problems, war, energy or supply issues), Alto Curtain has the right to suspend or dissolve the agreement without compensation.
16. Applicable law
16.1 These terms and conditions are governed by Dutch law.
16.2 Disputes shall be submitted to the court of Amsterdam.
